Hon’ble Madam Justice Tungalag Chuluun addressing the 8th International Conference of Chief Justices of the World
 

I am greatly honored and privileged to represent the Hon'ble Chief Justice of Mongolia Mr. BATDELGER Sodnomdarjaa at this 8th International Conference of Chief Justices of the World-the World Judiciary Summit 2007.

It gives me the greatest pleasure to attend such a distinguished gathering of persons who assembled here to help build global public support for enforceable international law and empowering the International Court of Justice for the safe and secure future of world's children.

During eighteen years after the entry into force of the Convention on the Rights of the Child there have been important steps forward. New legislation has been developed with strengthened international standards, such as the Optional Protocols to the Convention on the Rights of the Child on the sale of children, child prostitution and child pornography and on the use of children in armed conflicts. There have been a number of important international meetings, such as the Yokohama World Congress against Commercial Sexual Exploitation of Children in 2001 or the United Nations General Assembly Special Session on Children in 2002, which have reaffirmed the commitment of governments and civil society organizations to child protection and even laid out plans to achieve it.

Despite these commitments and promises, children continue to suffer violence, abuse and exploitation every day. We will achieve a world for children when we have succeeded in protecting every child from exploitation, violence, abuse and neglect.

This conference gives a great opportunity to us to share the minds and experiences as a member of the international community towards preventing and combating transnational crimes, crime against humankind. Today, transnational crimes demand enforceable International law that is universally applicable to all the countries and peoples of the world. Present time, International law is becoming the main tools of achieving peace between nations and the legal basis for peace and international security in the world. It would be wonderful, indeed, if there could be a new world order that allows a world parliament ensure world peace, implement global steps to conserve the environment and outlaw and eliminate all weapons of mass destruction, thus safeguarding the future of world's children, born and yet-to-be-born. However, we have to understand that it is almost impossible to be practical immediately, as it demands complete transformation and changing of the world order. Therefore, there is need for effective reforms of the United Nations Charter some of the objectives of which remain elusive. Enforcement of international laws through international organizations seems to be best suited to assure uniformity and efficacy. Also, judiciaries of the world should play an effective role in advancing international law by allowing it to be the main tools that guides their interpretation of national law.

With a rapid development in science and technology the world has become a global village which needs unity of humankind and peaceful life. We, the people of Mongolia, aspiring to the supreme objective of building a humane and democratic civil society in the country proclaim the Constitution of Mongolia which declares that "Mongolia shall fulfill in good faith its obligations under international treaties to which it is a Party; the international treaties to which Mongolia is a Party, shall become effective as domestic legislation upon the entry into force of the laws on their ratification or accession" / Article 10 /. Moreover, most national legislation has a provision on the supremacy of provisions of international treaties in cases of contradiction.

Finally, once again I would commend the Students' Appeal of CMS on behalf of World's two-billion children and generations and let me extend my cordial thanks to Mr. Jagdish Gandhi, and the all teachers and students of CMS for convening this important Conference for the 8th time and great success to the all attendees.
